On Jan. 10, 2006, the Denver Post reported that the White House was considering three prominent conservative women from Colorado for a soon-to-be-vacated Colorado-based seat on the Court of Appeals for the Tenth Circuit. Two days later a lawyer for Colorado billionaire Philip Anschutz, a major donor to Republican campaigns and conservative organizations, sent this letter to White House Counsel Harriet Miers suggesting that the Bush administration instead consider nominating Gorsuch, then a 38-year-old who had joined the Justice Department seven months earlier. Prior to that he had worked as an outside counsel for Anschutz.
